GUAM Police Department
officer Joveno Catama Fernandez Jr. will enter a guilty plea on the charges
of marriage fraud and perjury filed against him and a Chinese national,
Ju Mi An.
Fernandez was indicted on July 26 after entering into a marriage with
Ju Mi An for the purpose of evading immigration laws, according to the
grand jury charges filed in the U.S. District Court of Guam.
On Wednesday, his attorney, Federal Public Defender John Gorman, filed
a motion to schedule a change of plea hearing and vacate the Oct. 16 trial
date of the police officer.
U.S. Magistrate Judge Joaquin Manibusan Jr. scheduled Fernandezs
change of plea hearing for Oct. 15 at 9 a.m.
The trial of Ju Mi An continued.
The couple reportedly got married on Oct. 11, 2006 on Guam.
On May 16, 2007, Fernandez took an oath to testify before Citizenship
and Immigration Services adjudication officer Matthew Mumper concerning
a petition for an alien relative signed by Fernandez on Feb. 2, 2007.
Fernandez allegedly stated a lie.
On the same occasion, Ju Mi An took an oath concerning an application
to register a permanent resident status or adjust a status she signed
on Feb. 2, 2007.
The Chinese national also lied in the immigration documents.
The couple was released on their own personal cognizance with several
conditions such as staying away from all ports, surrendering firearm and
firearm identification, and remaining at a fixed address.
