CSC affirms GIAA decision to fire employee

THE decision of the airport management to terminate an employee who was involved in the alleged parking scam at A.B. Won Pat International Airport was upheld by the Civil Service Commission.
CSC issued a decision and judgment on the adverse action appeal filed by Michael G. Cruz who complained that he was improperly dismissed.
Cruz was employed at GIAA assigned to work in the parking lot as an attendant and was tasked with receiving and dispensing money.
He was implicated in a widespread investigation of police and GIAA management concerning possible fraudulent activity occurring at the parking lot.
Cruz with nine other airport employees were arrested and indicted in the Superior Court of Guam after investigation showed that several airport workers were involved in the "pocketing" or theft of parking lot revenues.
The said employees were also falsifying their and their co-workers attendance records.
The airport management took adverse action against Cruz based on several grounds such as misuse or theft of government property, actual or attempted theft of government property , criminal, dishonest, or notoriously disgraceful conduct and falsification , misstatement or concealment of material fact in connection with any official record.
After receiving the final notice of adverse action, Cruz appealed his dismissal to the CSC.
After a hearing on Feb. 8, 2007, the Commission agreed with airport management that the substantial evidence should be used by the CSC in the appeal.
By a vote of 5-1, the Commission determined that the action of the airport management in issuing the adverse action and dismissing Cruz was proper. The dissenting Commissioner would have suspended but not terminated the parking attendant.
Executive manager Jesus Torres earlier stated that the airport has been cheated out of about $70,000 in revenue.
