Robbery case dismissed

DUE to insufficient evidence, the court dismissed a robbery case against a man who allegedly took a tourist’s purse after taking her picture.
Rudolph Junior Cruz was charged with attempted robbery and commission of a felony while on release. The case was charged via information as opposed to an indictment.
The Attorney General’s Office filed the information on Aug. 3, 2006.
On Nov. 15, 2006, Assistant Public Defender Pablo M. Aglubat filed a motion to dismiss with two arguments: first, the government failed to file an information within 15 days after the judge issued the order commanding the defendant to answer; and second, the evidence presented during the preliminary hearing was insufficient to justify a finding of probable cause by the judge.
The AGO argued that the Aug. 3, 2006 filing of information satisfies the requirements of the statute.
As to the defense’s second argument, the government contended that the judge found probable cause for all charges based on the evidence presented.
