Drug user with firearm gets 1 day in jail

GUAM District Court Chief Judge Frances Tydingco-Gatewood gave a drug user a second chance by giving him a sentence of only one day in jail and put him under probation for three years.
Judge Tydingco-Gatewood took into consideration Bernardo Dait’s appeal to consider the time he already served and a period of supervised release because he needs to take care of his 77-year-old mother and a minor son.
The court also noted the recommendation of Dait’s lawyer, John Gorman of the Federal Public Defender’s Office, who said that the defendant showed his remorse and is now a reformed man.
Dait, 33, was arrested on April 21, 2006 while he was under the influence of methamphetamine. On the same date, Dait was in possession of four firearms.
Dait entered a guilty plea to charges of drug use in possession of a firearm on Sept. 8, 2006.
The maximum sentence for his offense is 10 years of incarceration, a $250,000 fine, and a supervised release of not more than three years.
He was ordered released by the court during yesterday’s sentencing hearing.
