Man sues 2 motorists

A MAN has sued two motorists for negligence over the injuries he sustained when his car was hit in a three-vehicle collision incident last year.
Joseph M. Sablan through attorney David G. Banes filed the complaint against Jin Xia Liu and Margarita Repeki Agulto in Superior Court.
The complaint stated that Jin Xia Liu was the driver and the registered owner of a 2001 Toyota Echo while Agulto was the driver of a 1997 Nissan Sentra.
On Oct. 13, 2006, Sablan said he was driving a 1991 Nissan pick-up truck and was traveling along Beach Road in San Jose.
While Sablan’s vehicle was stopped and waiting for the traffic to move, he was suddenly hit from behind by Liu’s Toyoya Echo which was, in turn, hit by Agulto’s Nissan Sentra.
The force or the impact of the collision resulted in Sablan’s whiplash injury and neck pain, his complaint stated.
It added that Liu negligently and carelessly operated her vehicle and failed to keep a proper lookout for other users of the road.
According to the complaint, Agulto, “with deliberate disregard and reckless indifference to the safety of others, recklessly, grossly, negligently and carelessly operated her vehicle and failed to keep a proper lookout for other users of the road.”
The complaint stated that Sablan suffered physical injuries requiring the services of physicians, nurses and other medical and rehabilitative personnel.
Sablan, the complaint added, continues to suffer severe and permanent physical and mental pain and anguish and suffered damages such as lost wages, future earnings and earning capacity.
Sablan is seeking general and special damages in an amount to be proven at trial, pre-judgment and post-judgment interest, punitive damages, cost of suit and such other “and equitable relief as the court deems just and proper.”
