THE Superior Court has ordered
the deportation of a 31-year-old overstaying garment worker.
Superior Court Judge David A. Wiseman ordered Xiaoling Zhangs deportation
after the governments and the garment workers counsel submitted
a stipulation agreeing to an order of deportation.
Zhang signed the stipulation which stated that she does not dispute that
she is a national of the Peoples Republic of China and is a deportable
alien.
According to the stipulation, Zhang overstayed her entry permit and has
no legal right to remain in the CNMI.
Wiseman ordered that any bail posted by Zhang is exonerated and should
be returned to her.
The judge also ordered the release of her passport for repatriation purposes.
Zhang, according to the affidavit of immigration investigator Nicolas
T. Reyes, was issued a permit on Feb. 3, 2005 which expired on March 16,
2006.
Zhang did not file a labor complaint and does not have a temporary work
authorization to work in the commonwealth.
She does not have an application for consensual transfer, for renewal
or extension.
The immigration affidavit stated that Zhang also gave authorities other
names and identified herself as Aimin Zhi.
Zhang entered the CNMI as a hand sewer for Concorde Garment and later
transferred to Olopai Tarsicio Kaipat as a farm worker when her contract
expired on Jan. 22, 2005.
