THE brothers who were arrested and charged for burglarizing and robbing the MCV office last year appeared again in court for preliminary proceedings.
Joseph A. Crisostomo, 33 and his brother Calistro A. Crisostomo, 23, appeared before Superior Court Judge David A. Wiseman yesterday morning.
Calistro Crisostomo, through his counsel George Hasselback, waived his right for a preliminary hearing.
The court set his arraignment for Aug. 13.
According to the court, there is probable cause to believe that Joseph Crisostomo, who is represented by attorney Steve Nutting, committed the offenses charged against him.
He was charged with conspiracy to commit burglary, burglary and theft.
His arraignment was also set for Monday, Aug. 13.
The brothers were remanded to the custody of the Department of Corrections after the hearing.
Wiseman has yet to sign the order for probable cause.
The information filed in court by Chief Prosecutor Jeffery Warfield Sr., stated that the brothers and William Jerome T. Deleon Guerrero, 24, on Sept. 10 or 11, 2006, “did conspire with each other to unlawfully enter the building of Marianas Cable Vision in Susupe with the purpose of committing theft.”
The information stated that the three defendants unlawfully entered the building and took $34,319.25 in cash, checks and credit card receipts.
Deleon Guerrero is now out on bail.
The police affidavit submitted to the court stated that the burglary was discovered on Sept. 11, 2006 by an employee of MCV.
The incident was reported to the police at 8:14 a.m. by Mark Birmingham.
The identities of the suspects were revealed by the girlfriend of one of them.
The woman told investigators that the defendants were responsible for the burglary and theft at the MCV office last year.
The Crisostomo brothers were already in custody for other offenses and were served with warrants while in prison.
Deleon Guerrero was arrested on July 12.
