A MAN sued a landowner for
nonpayment of debts amounting to $16,250.
Juan M. Cabrera, through attorney Douglas F. Cushnie, filed the complaint
in Superior Court against Edward T. Benavente.
The plaintiff is seeking an order of quieting title to a real property
situated in As Matuis or, alternatively, damages in an amount equivalent
to the value of the property or the amount paid by the plaintiff to Financial
Services.
The plaintiff is also seeking attorneys fees, cost of suit, pre-judgment
interest and other relief which the court deems proper.
The defendant is the owner of a real property in As Matuis.
According to the complaint, the defendant and the plaintiff entered into
a loan agreement with the Financial and Insurance Services Group Inc.
in the principal amount of $16,000 on April 11, 2005. The two entered
into an agreement which provided that if the defendant failed to meet
his responsibilities to make monthly payments to Financial Services and
defaulted for a period to exceed 90 days, the defendant would surrender,
convey and forever release unto the grantee all rights, interest or claim
in the property.
