A MAN was convicted yesterday
for beating up his wife when she refused to have sex with him.
Martin Sanchez Dela Cruz, 37, appeared for a change of plea hearing yesterday
morning with Assistant Public Defender Kelley Butcher.
Associate Judge David A. Wiseman accepted the plea and sentenced Dela
Cruz to one year of imprisonment all suspended except for five days with
four days credit for time already served in jail.
Dela Cruz will report to the Department of Corrections on Feb. 8 at 8
a.m. to serve his unsuspended one day jail sentence and he will be released
on Feb. 9 at 8 a.m.
Assistant Attorney General Anne Marie Roy agreed to dismiss the disturbing
the peace charge in exchange for the guilty plea.
Wiseman ordered Dela Cruz to pay a fine of $100, an assessment fee of
$50 and perform 60 hours of community work service with a minimum of six
hours per month.
Dela Cruz will submit a letter of apology to his common-law wife and attend
anger management class, alcohol counseling and parenting class.
According to the AGO, Dela Cruz on Nov. 13, 2006 slapped, choked and punched
the victim.
The police affidavit stated that Dela Cruz got mad when the victim refused
to have sex with him because she was having her monthly period.
After accusing her of having an affair with another man, Dela Cruz assaulted
her.
In other news, Wiseman also convicted another man for punching his girlfriend
on May 18, 2006.
Antonio H. Indalecio also appeared for a change of plea hearing yesterday
with Assistant Public Defender Kelley Butcher.
Assistant Attorney General Anne Marie Roy represented the government.
Indalecio entered a guilty plea to one count of assault and battery.
Wiseman accepted the plea and sentenced Indalecio to one year of imprisonment,
all suspended except for seven days.
Indalecio will report to the Department of Corrections today, Feb. 2,
at 8 a.m. to start serving his unsuspended sentence and he will be released
on Feb. 9 at 8 am.
Indalecio will pay a fine of $250 and an assessment fee of $50. He will
also submit a letter of apology to the victim.
