A MAN charged for not paying
his bills and for issuing bad checks pleaded guilty yesterday.
David Fogata appeared for a change of plea hearing with his counsel Assistant
Public Defender Samuel Randall IV.
Assistant Attorney General Anne Marie Roy represented the government.
Associate Judge David A. Wiseman accepted the plea and sentenced Fogata
to one year of imprisonment, all suspended except for one day.
Fogata was placed on supervised probation for a period of three years.
He will pay a fine of $350, a court assessment fee of $50 and a restitution
fee of $274.01.
He will, moreover, perform 90 hours of community work service and submit
a letter of apology to the victims, the USSP Mart, the Hyatt Regency Hotel
and the Fiesta Resort & Spa.
Fogata was charged with four counts of issuance of bad checks and two
counts of theft of service.
He issued a check to USSP Mart on July 29, 2006 in the amount of $22.91.
On Aug. 11, 2006, he dined at the Hyatt where he ordered food valued at
$14.75 and did not pay for it.
Fogata was arrested and released the following day.
Shortly afterward, Fogata went to the Fiesta Resort & Spa and ordered
food and drinks worth $45. Fogata was arrested again when he refused to
pay his bill.
