A 27-year-old man got a sentence
of 30 days of imprisonment after the Superior Court gave him consideration
for taking full responsibility for his actions when he committed the offense
of violating an order of protection and assault and battery.
Associate Judge David A. Wiseman said the court also considered the fact
that Arnold Litulumar Balbin is supporting a family.
According to the judge, the deterrent factor was not served by Balbins
sentence of only six days jail time in a previous assault and battery
conviction. Balbin also violated the law with no jail time for a previous
burglary conviction.
Wiseman said a short jail term with several probation conditions will
best serve the interests of justice.
He sentenced Balbin to one year of imprisonmentm all suspended for the
crime of violating an order of protection. The sentence is suspended except
for the 30 days.
For the crime of assault and battery, Balbin was sentenced to one year
of imprisonment, all suspended except for 30 days. The sentences will
run concurrently.
Balbin was also placed on probation for two years. He will pay a fine
of $100, and an assessment fee of $25. He will, moreover, undergo anger
management counseling and alcohol counseling.
Balbin was convicted of assault and battery and crime of violating an
order of protection during a bench trial on Jan. 22. He was acquitted
of a criminal mischief charge.
Balbin was charged for punching his wife in the presence of a child on
March 17, 2006 and for violating an order of protection issued by Judge
Kenneth Govendo on March 21, 2006 directing him to stay away from the
victims residence.
