THE U.S. District Court of
Guam issued a subpoena to at least 10 GovGuam officials handling the operation
of the Port Authority of Guam after a worker complained of unfair labor
practice.
Anthony Q. Sanders filed a civil case against the local government, citing
unlawful employment practices and discrimination when the Port Authority
of Guam failed to promote him.
Prior to his complaint, Sanders filed a discrimination charge with the
Equal Employment Opportunity Commission on Nov. 7, 2006.
Specific names of GovGuam officials are not provided in Sanders
complaint because he is still establishing their identities.
According to Sanders, GovGuam had employed him since Nov. 30, 1997 and
devoted his time, energy and best judgment exclusively to the best interest
of his employer.
On May 6, 2003, Sanders said GovGuam wrongfully failed to promote and
pay him based on his race.
He said during all relevant times, GovGuam management personnel were very
much aware of the discrimination against him yet ignored the discrimination
complaint and continued to fail to adequately supervise the workplace
or to train employees to prevent such discrimination.
As a result of the alleged unfair labor practice, the plaintiff said he
suffered substantial losses in earnings, job experience and other employee
benefits that he would have received if the defendants did not breach
their agreement in the employment contract.
