Couple, kids sue hotel for father’s injuries

A COUPLE and their minor children have sued a hotel for the injuries that the father sustained when he slipped and fell while at the hotel last year.
David Meyers, his wife Candace Meyers along with their three minor children, through attorney G. Anthony Long, filed the lawsuit in Superior Court against World Corporation, which is doing business as World Resort Hotel.
The plaintiffs filed claims of negligence, loss of consortium and emotional disturbance.
The complaint stated that on June 6, 2006, the family members were guests at the hotel and were at the water park.
Mr. Meyers was escorting his minor son to the restroom near the water park.
Both had to cross tile flooring to reach the restroom.
The complaint stated that the father and son did not know that the tile flooring was wet and extremely slippery.
Mr. Meyers slipped and fell on his back on the tile flooring. He struggled to stand but could not get off the floor without some assistance, the complaint stated.
It added that the fall caused him to suffer bodily injury and excruciating pain.
Mr. Meyers continues to suffer bodily injury and continues to experience pain, the complaint stated.
The defendant, it added, “breached its duty to maintain its premises in a safe condition for its guest by acts and omissions which include but are not limited to negligently and carelessly allowing the floor leading to the restroom from the water park to become slippery and hazardous.”
The defendant, moreover, “breached that duty by using a deficient design for the floor leading to the restroom near the water park.”
According to the complaint, due to Mr. Meyers’s injuries “he has not been able to perform his normal duties as husband and father to his wife and children and afford them the society afforded to them before his injuries.”
Because of his injuries, his wife and children “were deprived of his care, consideration, companionship, aid, society and assistance” of Mr. Meyers.
The complaint stated that the incident has caused fear and emotional disturbance to Mr. Meyers’s youngest son, who is three years old.
The son saw his father slip and fall and has “become scared for his own safety and otherwise suffered emotional disturbance.”
The plaintiffs are asking for compensatory damages and cost of suit.
