TWO former crewmen of a tour
boat have sued their former employers for unpaid wages and breach of contract.
Abdul Raheem and Momrej Bhuiyan through attorney Joseph E. Horey filed
the lawsuit in federal court against Joo Yeon Corp., Dwon Co., and
Hwang Yang Tack.
The defendants were the operators and owners of the Santa Rosa II, a tour
boat.
Raheem worked as a crewman from May 5, 2005 until Nov. 30, 2006.
Raheems hourly wage rate was $3.05 per hour for May 2005 and $3.50
per hour for the remainder of 2005 and $4 per hour in 2006.
Bhuiyan worked from Dec. 16, 2005 until Nov. 30, 2006. He was paid an
hourly wage rate of $4 per hour.
Raheem and Bhuiyan, according to the complaint, worked 10 hours per day,
seven days a week for a total of 70 hours per week.
The complaint stated that the plaintiffs were not paid their full regular
hourly wage for all hours worked, not paid at a rate one and a half time
their regular hourly rate for all work in excess of 40 hours per week.
The plaintiffs filed claims under violation of the Fair Labor Standards
Act, breach of contract and unjust enrichment.
They are seeking damages for unpaid overtime, an additional equal amount
as liquidated damages, compensatory damages, incidental and consequential
damages, damages for wages paid below the lawful minimum wage, restitution
of amounts by which the defendants have been unjustly enriched,
punitive damages, attorney fees and other relief.
The plaintiffs are also requesting a jury trial.
