Man’s application to hire alien worker denied

THE Department of Labor has denied a man’s application to hire an alien worker due to inadequate finance capability.
Hearing Officer Barry Hirshbein, in an administrative order, denied the application of Jose R. Ayuyu to hire Yue Hua Chen.
The denial is based on the supposed employer’s failure to meet the financial requirements to hire a nonresident worker, Hirshbein said.
During a hearing, Ayuyu testified that his fixed income is $480 and his total monthly income is $850.
Ayuyu, who is engaged in a small commercial operation, wants to hire Chen as a special minimum wage worker but he does not meet the minimum income requirements to hire a worker in this category, Hirshbein said.
Labor granted Chen 45 days from the date of the issuance of the administrative order to submit an application for transfer to a new employer.
If she fails to submit a timely application, Ayuyu will be notified to give her repatriation ticket within three days of service of notice of failure to transfer, and she must depart CNMI within 10 days after the ticket is delivered to Labor.
