Federal court dismisses citation vs man

U.S. District Court for NMI Chief Judge Alex R. Munson has dismissed a citation against a young man for illegal parking and for providing false information.
It was the federal government that filed the motion to dismiss the charges in the citation against Robert Lee Coldeen, 21.
No reason was given for the government’s motion.
The narrative report of the citation stated that on Oct. 22, 2006 at 5 p.m., three individuals were contacted for illegal parking at the Outer Cove Marina.
Sam Martinsen, National Park Service ranger, stated in his report that two vehicles were involved in alcohol.
He said three young men were spotted standing by a blue Toyota pick-up. The operator and the other men were drinking beer.
When Martinsen approached the individuals and asked who brought the 15 Budweiser beers to the pick-up, the three individuals denied doing so.
However Coldeen admitted later that he bought the beers and placed them at the back of the pick-up operated by his companion.
Coldeen was cited for providing false information while the operator of the pick-up was cited for open container of alcohol and the other man for possession of an alcohol beverage.
Coldeen was also warned for illegal parking while his two companions were warned for consumption of an alcoholic beverage.
The bench trial for Coldeen was set for Dec. 19, 2006 but it was cancelled when the court granted the government’s motion to dismiss the citation.
