THE landowner who was found
guilty by a federal jury of two counts for obstruction of a court order
was sentenced to one year of imprisonment.
John S. Pangelinan appeared with attorney Steven Pixley before designated
federal Judge David A. Wiseman for the sentencing hearing.
The government, represented by Assistant U.S. Attorney Craig Moore. recommended
a sentence of two years while the defense recommended probation.
Wiseman said Pangelinan will participate in mental health and alcohol
education or counseling programs upon the completion of the hail sentence.
Wiseman added that Pangelinan will serve a term of supervised release
for one year:
The defendant, the judge added, shall not commit another federal,
state or local crime; shall not unlawfully possess a controlled substance
and shall refrain from any unlawful use of a controlled substance; shall
submit to up to one drug test within 15 days of release and at least two
periodic drug tests thereafter for use of a controlled substance.
Pangelinan, moreover, will pay a fine of $7,500 and a special assessment
fee of $50.
He was ordered not to incur new credit charges or open additional lines
of credit without approval of the probation office unless he is in compliance
with the payment schedule.
Pangelinan is likewise restricted from transferring, hypothecating, dealing
or manipulating any assets or income while his fine is outstanding.
Hypothecate is a generic term for using property to secure
payment of a loan, which includes mortgages, pledges, and putting up collateral.
The judge stated that the defendant cannot circumvent, in any way, the
intended order of this court.
Pangelinan was found guilty in September.
He was indicted after writing a letter to the editor that warned the public
not to purchase his property which was supposed to be auctioned as ordered
by the court.
