A COUPLE was sued by a construction
firm for breach of contract when they hired another firm to construct
their three-bedroom concrete house in Kagman.
RPM Corp., through attorney S. Joshua Berger, filed the complaint in Superior
Court against Michael Itibus Kukkum Jr. and Lucinda Taitano Cabrera.
The complaint stated that the defendants on Feb. 1, 2006 entered into
a construction contract with the plaintiff.
The plaintiff was supposed to construct the couples house in Kagman
III.
According to the complaint, once the contract was signed, the construction
firm began incurring cost in preparation for the construction of the house.
But the defendants later contacted another contractor for a lower amount,
the complaint stated.
It added that not only did the defendants breach the contract by hiring
a different construction firm after the fact, but additionally breached
the contract by using the plaintiffs building plans in the construction
of their home.
RFM is asking for damages in the principal amount of $18,744 which is
the out of pocket cost expended by the company, court cost, attorney fees
and for other relief.
