A MAN yesterday
entered a plea agreement with federal lawyers and admitted that he used
controlled substance while in possession of a firearm.
David Pablo Bautista, 53, agreed to plead guilty to information charging
him with one count of drug use while in possession of a firearm.
He admitted that between Jan. 1, 2004 and Dec. 31, 2005, he used crystal
methamphetamine. At the same time, he received a firearm, a Ruger silver/black
handled revolver, which was shipped to him from the mainland.
Bautista also acknowledged that he exchanged the revolver for approximately
$150 worth of crystal methamphetamine with Judith Mateo, a known distributor
of methamphetamine who is now locked up in jail.
Mateo was identified by authorities as the one who bought the firearm
from Bautista in exchange for some ice.
Bautista entered a guilty plea to avoid the maximum sentence of 10 years
of imprisonment and $250,000 fine.
If he violates the condition of his supervised release, this may be revoked
by the court and sentence him up to an additional two years of incarceration.
Meanwhile, Mateo, who asserted her ownership interest in the Barrigada
house and lot which is under forfeiture, remains in the custody of the
United States Marshal Service.
She is expected to be back in district court today at 9:30 a.m. to participate
in the scheduling conference for the forfeiture hearing of Lot. No. 2343-9-1
in Barrigada.
The said property is under forfeiture claim after federal authorities
identified it as a venue used in transacting illegal distribution of methamphetamine.
Mateo, 41, earlier entered a guilty plea to an indictment charging her
with conspiracy to distribute methamphetamine in an amount of more than
50 grams and use of a firearm during, and in relation to, a drug trafficking
crime.
She was arrested in her Barrigada residence where she kept $51,836 which
is also a subject of forfeiture hearing in the district court.
