TWO insurance firms were sued
by a motorist for nonpayment of insurance benefits after her car was damaged
in a collision.
Qui Xiang You, through attorney Reynaldo Yana, filed the complaint against
AON Insurance Micronesia (Saipan) and Century Insurance Co. Ltd.
AON is the general agent of Century, the complaint stated.
It added that AON issued a Century insurance automobile policy with comprehensive
coverage for the plaintiffs 2005 Toyota Corolla 4-door sedan.
The policy required the defendants to pay for any direct and accidental
loss of or damage to the automobile.
The complaint stated that on April 17, 2006, Qui Xiang You was involved
in an accident while driving her vehicle.
Her vehicle was hit by another car when it suddenly stopped while traveling
ahead of her.
The sudden stop caused damage to her car.
On May 3, 2006, Qui Xiang You filed an accident notice with the police,
attaching the traffic crash report, estimates for parts and labor for
repair of the car from Microl Corp amounting to $9,788.11; $10,976.67
from Joeten Motor Co. Inc.; and $7,863.44 from New Pacifica Trading Inc.
Qui Xiang You came to the defendants offices four times to get payment
for the repairs needed by her car.
The complaint stated that the defendants failed to pay the insurance benefits.
The defendants have also failed to give Qui Xiang You any notice whether
or not they disagree with any of the estimates that the plaintiff attached
to the notice, the complaint added.
According to the complaint, for the last eight months and until the present,
the insurance firms chose not to act on the plaintiffs claims for
benefits under the automobile insurance policy.
The complaint stated that the defendants in action caused Qui Xiang You
to suffer the loss and right to enjoy the use of her car, the amount of
which will be determined during the trial.
Qui Xiang You is seeking judgment in her favor against Century Insurance
and AON in the amount of $9,751.06 for the repair of the car, for compensatory
damages as a result of her sufferings, attorney fees and cost of suit,
and for other relief the court deems just and proper.
