A 20-year-old man was arrested on Tuesday for sexually abusing a minor.
Pascual K. Deleon Guerrero was brought to Superior Court for a bail hearing yesterday morning.
Associate Judge David A. Wiseman imposed a $50,000 cash bail, and ordered Deleon Guerrero to appear at 3 p.m. yesterday for a bail modification hearing.
Deleon Guerrero was first arrested on Sunday night after the victim’s brother-in-law reported the incident to the police.
He was released on Monday night but was arrested again on Tuesday pursuant to an arrest warrant.
According to the affidavit of Detective Patrick Earl Maanao of the Department of Public Safety’s Criminal Investigation Bureau, the victim’s brother-in-law called DPS on Sunday at 4:57 p.m. and reported that his sister-in-law, who is only 12 years-old, was sexually abused by his neighbor.
The victim’s sister earlier saw her and Deleon Guerrero together at a movie theater.
The victim’s sister later told her common-law husband to ask Deleon Guerrero why he was in the company of the victim.
At first, Deleon Guerrero denied watching a movie with the victim but when the victim’s brother-in-law informed him that someone had seen them, he admitted going out with the victim.
When the brother-in-law asked Deleon Guerrero if he touched the victim, the defendant started crying and admitted having sex with the victim.
The victim’s brother-in-law also told the defendant to tell his mother about the incident, which Deleon Guerrero did for fear that his neighbor would call police.
The victim’s brother-in-law then went home and called the police.
On Tuesday, the victim was interviewed by Resel Magofna of the Division of Youth Services and she admitted that she had sex with the defendant on two separate occasions at his residence last summer.
A warrant of arrest was then issued against Deleon Guerrero.
