A COUPLE, indicted
for selling firearms and explosive materials without a license, pleaded
not guilty to the charges and were scheduled for trial on March 8.
Peter Ogo Aguero, 42, and his wife Linda G. Aguero, 39, of Mangilao, were
charged with four counts of dealing in firearms, five counts related to
the explosive materials, and improper storage of explosives.
During their initial appearance on Jan. 12, they were released on their
own recognizance with certain conditions.
However, following the hearing, the defendants were tested for controlled
substances at the U.S. Probation Office and Linda Aguero tested positive
for methamphetamine use.
She executed a statement to the U.S. Probation Office and admitted that
she used ice the previous day, Jan. 11.
In light of the drug test results, probation officer Maria Cruz requested
that the court modify the pretrial release conditions of the defendants
to require the defendants to submit to any method of testing required
by the pretrial services office or the supervising officer for determining
whether the defendants are using a prohibited substance.
The probation officer also recommended that the defendants participate
in a program of substance abuse therapy and counseling if deemed advisable
by the pretrial services office.
Based on the grand jury indictment, the Aguero couple sold a Savage shotgun,
rifles, blasting detonating caps and pest control devices from Feb. 25,
2005 to April 14, 2005.
From Feb. 25, 2005 to March 21, 2006, the couple stored high explosives
in a manner not in conformity with regulations promulgated by the Secretary
of the Treasury.
The defendants allegedly stored blasting caps, detonating devices, and
pest control devices in their residence on Anthurum St. in Pagat, Mangilao.
