A MAN who was sentenced six
years ago for the offense of conspiracy to import methamphetamine may
go back to jail after he tested positive for illegal substance use.
Antonino Santos Alano was the subject of a petition for the revocation
of supervised release by the U.S. Probation Office after a series of violations
of the court-ordered conditions.
Alano was sentenced to 71 months of imprisonment on Oct. 25, 2000 and
his five-year supervised release commenced on Aug. 31, 2004.
Part of the condition imposed by the U.S. District Court was for Alano
to refrain from any unlawful use of a controlled substance, submit to
one drug test within 15 days of release from imprisonment, and at least
two periodic drug tests thereafter as directed by the probation officer.
On Dec. 21, 2006, his probation officer filed a petition before the court
and asked to summon Alano after the offender tested positive for ice
during the Oct. 23 and Nov. 3, 2006 drug tests.
An additional violation was reported by the U.S. Probation Office to the
court after Alano tested positive for methamphetamine on Jan. 16, 2007,
and admitted to using amphetamine on Jan. 15, 2007.
He also failed to show for urinalysis on Jan. 5, 8 and 11, 2007.
A special condition was recommended by probation office specialist Carmen
D. OMallan requiring Alano to participate in a substance abuse treatment
program approved by the U.S. Probation Office.
The offender, who was fired from his job as a wait staff in a hotel, was
also recommended to attend emergency counseling sessions to address his
drug relapse which has caused a family crisis, according to OMallan.
Alano was summoned yesterday for a hearing to answer or show cause why
his term of supervised release should not be revoked.
The court is expected to issue an order on his violations within the week.
