Court may revoke bail of self-confessed ‘ice’ peddler

A MAN who was earlier released on bail after admitting that he attempted to possess, with an intent to distribute, methamphetamine or “ice” was summoned to appear in court today after he tested positive for marijuana use.
Nathaniel T. Chaco, 26, entered a plea agreement on July 14, 2006 and admitted that on July 6, 2006, he attempted to receive and deliver over 5 grams of “ice” which arrived at the U.S. Post Office in Guam.
Chaco was released on a personal recognizance bond with the condition that he will report to the Drug Enforcement Administration and the U.S. Probation Office as directed.
He was ordered to refrain from consuming alcohol or any unlawful substance, and should submit to drug and alcohol testing.
On July 31, 2006, the U.S. Probation Office reported that Chaco tested positive for marijuana.
Chaco tested positive again for marijuana on Oct. 16, 2006 but no action was taken against him because the defendant agreed to seek substance abuse treatment with the Department of Mental Health and Substance Abuse.
Conditions of Chaco’s release were modified on Dec. 18, 2006 after he tested positive again for marijuana during further tests.
Chaco said he used marijuana with friends and succumbed to peer pressure.
According to Chief U.S. Probation Officer Frank Michael Cruz, Chaco tested positive for marijuana eight times.
Cruz recommended the court to summon Chaco for a hearing to determine if his bail should be revoked or modified.
Chaco is scheduled to see Chief Judge Frances Tydingco-Gatewood at 9:30 this morning.
