THE U.S. Probation
Office has asked the federal court to summon a woman for violating her
release conditions. The woman was recently indicted for stealing from
the Navy Exchange.
In a petition filed before the U.S. District Court of Guam, U.S. Probation
Officer Grace Flores wants the presence of Arlene Bownds to answer or
show cause why bail should not be revoked or why conditions of her release
should not be modified.
A grand jury indictment was filed against Bownds last month after an investigation
showed that she stole some $4,641 worth of property from the Navy Exchange
from Aug. 22, 2006 to Sept. 1, 2006.
She is facing charges of theft of government property and entering military,
naval or coast guard property.
On Jan. 26, 2007, Bownds made an initial appearance before Magistrate
Judge Joaquin Manibusan and was granted pre-trial release with conditions.
One of the conditions is to remain at a fixed address unless given permission
by the U.S. Probation Office.
However, during the order setting the conditions of her release, Bownds
indicated an Agana Heights address which is different from her Dededo
residence.
Bownds was also required to report to the U.S. Probation Office for supervision
as directed but the probation officer reported that the defendant failed
to show up for her Feb. 7, 2007 appointment.
She was also ordered to submit to any method of testing required by the
pre-trial services officer for determining whether she is using a prohibited
substance but Bownds also failed to appear for the Feb. 7, 2007 drug test
schedule.
Bownds, who was specifically instructed to refrain from the use or unlawful
possession of a narcotic drug or other controlled substance, also tested
positive for methamphetamine on Feb. 14, 2007.
The accused admitted in writing to using ice on Feb. 11, 2007.
