THE Superior Court has granted a motion for bail modification for four of seven copper wire suspects.
Associate Judge David A. Wiseman modified the bail amounts imposed on Jason Mad, Fanis Denziro, Erwin Evence and Jesse Peredo.
Wiseman allowed Mad, Denziro and Evence to post a $10,000 appearance bond.
Evence, who was represented by attorney Bruce Berline, was allowed to post a $250 cash bail and a $10,000 appearance bond.
Evence will be released from the custody of the Department of Corrections through a third party custodian — his brother and his common-law wife.
Evence was ordered by Judge Wiseman to stay away from co-defendants Gloyd Martin, Jason Mad, Sumang Riungel, Sylvan Pua and Peredo and any recycling centers.
Denziro, who was represented by attorney Matthew Smith, was allowed to post 1 percent of his $50,000 bail and a $10,000 appearance bond.
Wiseman ordered Denziro released from the custody of the Department of Corrections to a third party custodian — the defendant’s uncle.
Mad, represented by attorney Stephen Woodruff, was allowed to post 1 percent of his $50,000 cash bail and a $10,000 appearance bond.
Mad and Denziro were also ordered to stay away from co-defendants.
The three defendants appeared for a bail modification hearing on Wednesday morning.
They were ordered to return to the court on March 5 at 9 a.m. for arraignment.
Peredo’s bail was also modified and he was released from the custody of the Department of Corrections on Friday.
Peredo’s third party custodian is his mother.
The court found probable cause to believe that Mad, Martin, Denziro, Pua, Evence, Peredo and Riungel committed the crimes of conspiracy to commit theft, theft and criminal mischief.
The suspects appeared for a preliminary hearing last week.
The seven defendants were apprehended by the Department of Public Safety’s Thief Apprehension Select Coalition and the Attorney General’s Office Investigation Unit on Feb. 9 and 10.
A police affidavit stated that on Jan. 15, TASC personnel were conducting a random check at the Triple Star Recycling Center in As Perdido when they encountered a minor in possession of wire stuffed inside a green duffle bag.
During a preliminary investigation, the minor admitted that the wire was stolen from the municipal council office in Chalan Kanoa behind the U.S. Post Office.
The minor identified his two companions as Evence and Peredo.
The minor was arrested on Feb. 9, at his residence in Gualo Rai.
Riungel, Mad, Martin and Denziro were named as suspects in the theft of power line from water well sites in Sadog Tasi on Jan. 10.
A preliminary investigation revealed that the suspects stole an undetermined length of power line.
Police said the incident caused a major setback as the water wells provided water to the numerous residents in the area.
CUC later confirmed that the northern sector, which includes Capital Hill, Puerto Rico, Tanapag and Sadog Tasi, experienced water shortages due to the theft.
Police said Riungel, Martin and Pua were also responsible for the theft at the CUC water well sites near the airport on Sept. 9, 2006.
The suspects stole an estimated 450 feet of power line and two water wells were rendered useless after the suspects stole the drop lines leading to the wells.
