THE Attorney General’s Office has filed a motion to dismiss the case against a man charged for committing marriage fraud, whom the AGO says should be deported instead.
Assistant Attorney General Kevin Lynch asked the Superior Court to enter an order of dismissal of the criminal case against Mohammad Nazrul Islam, 35, without prejudice, and to proceed with a deportation action against the defendant.
An arrest warrant for Islam was issued on Feb. 16.
After his arrest at a poker establishment in San Antonio, Islam was brought to the court for a bail hearing on Feb. 20 and was released from the custody of the Department of Corrections when he posted a bond of $1,500.
The Division of Immigration affidavit submitted to the court stated that Islam married a local minor on June 9, 2006 at the Northern Islands mayor’s office in Garapan.
The marriage was performed by Mayor Valentin I. Taisaken of the Northern Islands.
The affidavit stated that Islam paid the girl and her family $2,000 after the marriage.
Just a week ago, Islam’s friend, Jesse John Stephen, 29, was also arrested for marriage fraud.
Stephen married Islam’s girlfriend to help her obtain immediate relative status.
Stephen and Islam’s girlfriend, Lili Wang, also known as Lily Wang Stephen, were married on Sept. 1, 2004 in Superior Court. Islam and Stephen’s real girlfriend acted as witnesses.
