Man gets 3 years for conspiracy to commit burglary and theft

A MAN was sentenced to three years of imprisonment after he was convicted of conspiracy to commit burglary and theft and attempted burglary.
Athen Remarii, 26, appeared for a change of plea hearing on Wednesday morning with his counsel Loren Sutton before Associate Judge Juan T. Lizama.
Remarii pleaded guilty to conspiracy to commit burglary and theft and attempted burglary.
Assistant Attorney General Joseph Taijeron agreed to dismiss the other charge of attempted theft against Remarii.
Lizama accepted the plea and sentenced Remarii to 30 months of imprisonment, all suspended except for 18 months with credit for time served for the conspiracy to commit burglary and theft, and another 30 months of imprisonment, all suspended except for 18 months with credit for time served for attempted burglary.
The sentences will run consecutively, which means that Remarii will serve 36 months or three years in jail without parole.
He was placed on probation for 60 months or five years and was ordered not to have any contact with the victim.
He was also ordered to submit a letter of apology to the victim, James Edward Phillips.
Remarii will pay a fine of $500 and a court assessment fee of $200.
He will pay restitution and probation fees to be assessed and determined by the Adult Probation Office.
Remarii, moreover, will perform 200 hours of community work service.
He was remanded to the custody of the Department of Corrections.
Remarii will appear in court on Jan. 10, 2008 at 1:30 pm for a review hearing.
Remarii was charged along with James Sanchez, 35, and a minor on July 3, 2006.
The police affidavit stated that the three were arrested on Sept. 1, 2006 for conspiracy to commit burglary and theft, attempted murder, assault with a dangerous weapon, disturbing the peace, aggravated assault and battery and criminal mischief.
A stabbing incident and attempted burglary at Phillips’s residence in San Vicente was reported to the police on July 3, 2006.
An investigation disclosed that the victim left his residence and later received an activated alarm call. He went home and found the minor suspect attempting to pry open a window guard rail on the second floor.
The victim and the minor suspect struggled when the suspect managed to pull out a knife and stab the victim in the chest and arm.
The minor suspect then jumped over the fence and ran into the bush area toward the Rifu garment factory.
Sanchez and Remarii and other minor companions were waiting in a black sedan parked at Rifu garment when the minor suspect arrived with messed hair and a bloody nose.
The four fled in the sedan.
