THE Superior Court has dismissed the deportation proceedings against two alien workers who were arrested for working illegally at the Rifu garment factory.
Associate Judge David A. Wiseman, in an order on Wednesday, dismissed the petition for an order to show cause against Wu Liyu, 29, and Xu Yiming, 33.
The government, through Assistant Attorney General Kevin Lynch, filed the motion for dismissal on March 2, stating that Xu Yiming has already obtained an immediate relative permit while Wu Liyu has been granted transfer relief by the Department of Labor and has normalized her immigration status.
Wu and Xu are citizens of the People’s Republic of China. They were arrested by authorities on April 27, 2006 after they were found working at Rifu Apparel Corp. in As Lito without lawful documentation.
Wu’s non-resident worker’s permit expired on June 29, 2005. She was employed as a hand sewer by Concorde garment.
Xu’s non-resident worker’s permit expired on Jan. 12, 2005. She was employed as a sewing machine operator by Michigan Inc.
