A FIREFIGHTER at the Guam
Fire Department was charged in Superior Court on Friday for driving under
the influence of alcohol and resisting arrest.
Johnny Reyes Newby, 47, of Talafofo, was arrested early Friday morning
after police learned that Newby was operating a Toyota RAV4 under the
influence of alcohol.
According to Guam Police Department public affairs officer Allan Guzman,
the pullover was only for DUI until the officers spotted a schedule two
controlled substance and some drug paraphernalia in the vehicle.
According to court documents, the vehicle Newby was operating failed to
come to a complete stop at a stop sign in Yona.
When the police officer questioned Newby if he had consumed alcoholic
beverages, Newby admitted to drinking a few beers.
The firefighter refused to take a field sobriety test so the police officer
arrested him for driving under the influence. Newby became non-cooperative
and refused to comply with the officers instructions.
Newby struggled with the arresting officer, and another uniformed GPD
officer had to assist in restraining him.
After he (Newby) was placed in handcuffs, Officer Leon Guerrero
saw a cold, partially consumed bottle of beer in the center console of
Newbys vehicle. Officers also found a heat-sealed plastic straw
on the ground where Newby had been restrained. Although the straw is commonly
associated with possession of a controlled substance, officers did not
conduct any testing on the substance to determine what it was, according
to the magistrate complaint.
