AN AMENDED decision and judgment
of the Civil Service Commission clarified an earlier ruling that Gerald
Javier, who was reemployed with the Guam International Airport Authority,
is not entitled to back pay from the date of his dismissal.
Javier is one of the 10 GIAA employees who were dismissed from their job
for their involvement in a parking scam at the airport.
He was removed from work in July 2005 following his indictment along with
nine other airport employees who were arrested after an investigation
into the airport parking scam.
Javier, Michael Gerard Cruz, Gerard Limtiaco Cabana, Eugene Toves and
Jolene Bucao were charged with theft by deception, theft by receiving
stolen property, theft of property held in trust, conspiracy, tampering
with records to conceal and deceive, and official misconduct.
An investigation showed that several employees were stealing money over
the last few years by overcharging tour companies.
GIAA earlier disclosed that the airport has been cheated out of more than
$100,000 in revenue.
Javier filed an appeal with GIAA that resulted in his reemployment to
begin on Oct. 10, 2006.
Confusion, however, ensued after Javier assumed that the decision and
judgment was effective July 2005 and not October 2006.
