A WOMAN and a man who were
both convicted in federal court for ice charges were sentenced
yesterday.
Julita Aldan Sablan was with attorney Steve Pixley while Ismike Magofna
appeared with attorney Stephanie Flores.
U.S. District Court for NMI Chief Judge Alex R. Munson sentenced Sablan
to 24 months of imprisonment with credit for time served while Magofna
was sentenced to one year of imprisonment.
Sablan, during imprisonment, will participate in a 500-hour drug treatment
program as approved by the Bureau of Prisons.
Sablan will also participate in vocational or educational programs to
include financial management.
After completing her prison sentence, she will serve six years of supervised
release.
Magofna was also ordered to participate in the same program and will serve
three years of supervised release.
Sablan and Magofna are prohibited from possessing a controlled substance
and firearm or other dangerous weapons and from the use of any alcoholic
beverages, and are required to obey all CNMI and federal laws.
Sablan will perform 300 hours of community work service and pay a special
assessment fee of $200.
Magofna will perform 200 hours of community work service and pay a special
assessment fee of $100.
The fines for both defendants were waived after it was determined that
they dont have the ability to pay.
Sablan was convicted of conspiracy to distribute a controlled substance
and possession with intent to distribute, and distribution of a controlled
substance.
A federal jury found her guilty of the charges on Dec. 15, 2006.
Sablan was indicted along with co-defendants Ismike Magofna and Greg Magofna
for conspiracy to distribute a controlled substance and possession with
intent to distribute, and distribution of a controlled substance.
The indictment against Greg Magofna was dismissed due to lack of evidence.
Ismike Magofna signed a plea agreement and entered a plea of guilty to
distribution of a controlled substance.
The charge of conspiracy to distribute a controlled substance and possession
with intent to distribute was dismissed.
Sablans jury trial was held on Dec. 11, 2006.
