A CITIZEN of Chuuk in the
Federated States of Micronesia will be deported for the second time when
the District Court of Guam sentenced him for reentering the U.S. territory
illegally.
Kitamichy Williander, 37, was ordered removed from Guam on Oct. 16, 2001
and was deported on Feb. 27, 2001 after he was convicted of aggravated
assault in the Superior Court of Guam on Oct. 17, 2000.
With his aggravated felony conviction, Williander is not allowed to reenter
the United States without receiving the consent of the Secretary of the
Department of Homeland Security.
Williander was indicted on illegal reentry charges on Jan. 24, 2007 and
was arrested two days later.
The maximum sentence for illegal reentry subsequent to a conviction for
an aggravated felony is 20 years imprisonment, a $250,000 fine, and three
years of supervised release.
Williander entered a plea agreement to avoid the maximum sentence but
he is guaranteed that he will be deported again to the FSM.
As this developed, another removed alien, who was indicted for illegal
reentry, was given a counsel from a federal public defender.
Young Taek Lee, who was deported on March 29, 2005 in New York, was rearrested
on Nov. 22, 2006 in Guam.
Lee had not received the consent of the attorney general of the United
States to reenter the U.S.
