A man arrested for assaulting
his common-law wife with a chair posted bail yesterday.
Albert S. Johnny, 41, appeared for a bail modification hearing yesterday
morning before Associate Judge David Wiseman.
Johnny, through Assistant Public Defender Douglas Hartig, posted an unsecured
bond of $1,800 and the court granted the defendants motion for bail
modification.
The court said Johnny could post 10 percent of the $2,000 cash bail and
an unsecured bond of $1,800.
The court also allowed the defendants release from the custody of
the Department of Corrections to a third party custodian his aunt.
Johnny was ordered to stay away from the victim and her minor children.
He was charged with one count of assault and battery for hitting and choking
his common-law wife on March 11.
The affidavit of Detective Andrea Ozawa stated that Johnny threw a chair
at the victim and tried to choke her in the presence of her seven-year-old
daughter.
The incident happened at the victims residence in Kagman I.
The victim was in the house at 8 p.m. when Johnny asked her to call his
aunt.
The victim went to the nearby house of a relative to make the call.
When she returned to their house, Johnny picked up a chair and threw it
at her, hitting her in the arm, the affidavit stated.
It added that Johnny then choked the victim and pulled her hair.
He forced the chair onto the victim, causing her to become stuck between
the chairs legs and while she was stuck, the defendant began to
choke her again, the affidavit stated.
The beating only stopped when Johnnys cousin came and stopped him
from further hurting the victim.
Johnny fled the area with a machete and crowbar while the victim called
police for assistance.
