A SUPERIOR Court
order placed complete control of the Paseo Stadium back in the hands of
the Department of Parks and Recreation.
The Attorney Generals Office represented DPR when
it filed a complaint against the Guam Baseball Federation for failure
to meet its obligations in a 2003 lease agreement.
Judge Katherine Maraman ruled that the lease was terminated in proper
order and returned control to DPR.
GBF and the Department of Parks and Recreation
signed a lease agreement in 2003 giving GBF full control over operations
and maintenance of the facility.
Earlier this month, acting Director Joe Duenas terminated that agreement
after meeting with the Guam Baseball Federation commissioner and the GBF
Board of Directors, notifying them of the decision to eliminate the Paseo
Stadium lease agreement.
Duenas dissolved the relationship after GBF failed to comply with
several requests to conform to the agreement. In an earlier statement,
Duenas said: What started out as a win-win agreement for the Government
of Guam and GBF has dissolved into two years of non-compliance issues,
and two years of unpaid rent and utilities totaling $37,141.20.
DPR has done everything in its power to make this partnership
work; unfortunately, this cannot be said of our current partner,
he added.
