Alicia Limtiaco yesterday said that the prosecutors division of her office
is currently reviewing the case involving a U.S. Air Force captain and
his wife for alleged criminal sexual conduct with their minor children
and possession of approximately 1,700 nude photos of minors and adults.
Limtiaco said she is constantly briefed by prosecutors on the status of
cases which she has not recused herself from, but the case of Michael
Eric Dunlop, 36, and Kendall Rachell Dunlop, 30, is under the responsibility
of Chief Prosecutor Phil Tydingco who is now actively investigating the
case to ensure effective prosecution and that the law of Guam is
served.
The attorney general did not discuss specific details of the Dunlops
case but told Variety that the government has 10 days from the time of
filing of the magistrate complaint to file an indictment.
The Dunlops remain behind bars on a $100,000 cash bail. They may no longer
need to raise funds for their bail if the Attorney Generals Office
fails to establish that it has jurisdiction over the case.
The question of jurisdiction was raised in the case due to information
that the pictures found in the house of the Dunlops were taken in the
couples previous residence in Texas.
The Dunlops, who are presently detained at the Hagatna detention facility,
have still not been indicted by the grand jury.
Kendall Dunlop was arrested Wednesday night while Michael Eric Dunlop
surrendered Thursday after their Perez Acres house in Yigo was raided.
They were charged with second-degree criminal sexual conduct as a first-degree
felony, photography of sexual acts involving a minor as a first-degree
felony, use of a child in obscene acts as a first-degree felony, and two
counts of child abuse as a misdemeanor.
