Airman, wife to appear in court today

A U.S. Air Force captain and his wife who were arrested for alleged criminal sexual conduct with their minor children and possession of nude photos of minors are scheduled to appear before Superior Court Judge Alberto Lamorena at 4 p.m. today.
Michael Eric Dunlop, 36, and his wife Kendall Rachelle Dunlop, 30, who remain behind bars on a $100,000 cash bail each, are expected to file a motion to dismiss the charges filed against them on the grounds that Guam has no jurisdiction over their case.
The defense will assert that the photos in their family album that were taken during a raid were not taken in Guam but were taken in their previous residence in Texas.
The Dunlops were arrested over a week ago but no grand jury indictment has been filed against them. The Attorney General’s Office said they are still reviewing and investigating the case to determine whether further evidence can be used against the Andersen Air Force Base bioenvironmental officer and his wife.
Their two minor sons are still under the custody of the Healing Hearts of Crisis Center.
The defense is also expected to question the statement taken by investigators from the five-year-old son who was interviewed without the consent of a necessary custodian.
The Dunlops lived in Perez Acres in Yigo. Their residence was raided last week after an investigation was initiated by Andersen Air Force Base law enforcement.
The couple was charged with second-degree criminal sexual conduct as a first-degree felony, photography of sexual acts involving a minor as a first-degree felony, use of a child in obscene acts as a first-degree felony, and two counts of child abuse as a misdemeanor.
