A 20-year-old man charged
for assaulting a co-suspect in a theft incident last year has been convicted
and sentenced to five days of imprisonment.
Sheldon U. Remoket entered a plea of guilty during a hearing on May 1.
Judge Kenneth L. Govendo accepted the plea and sentenced him to one year
of imprisonment all suspended except for 10 days with credit for five
days of time already served.
Remoket was ordered to report to the Department of Corrections on May
21, at 8 a.m. He will be released on May 26, at 8 a.m.
He was placed on probation for one year and will pay a fine of $250 and
a court assessment fee of $25.
He will likewise pay a probation fee to be determined by the Office of
Adult Probation.
Remoket will perform 100 hours of community work service and write a of
apology letter to the victim, Esfy Kapwich.
Remoket was ordered to stay away from the victim.
His review hearing was set for March 6, 2008.
Remoket was charged with assault and battery, obstructing justice, interference
with a witness, and disturbing the peace.
He appeared for a change of plea hearing on May 1 and through his counsel,
George Hasselback, entered a plea of guilty to the assault and battery
charge.
Assistant Attorney General Joseph Taijeron agreed to dismiss the other
charges.
According to the prosecution, the defendant choked, punched and kicked
the victim on Oct. 20, 2006.
The affidavit of the Department of Public Safety stated that the victim
had been drinking at a basketball court in Dandan homestead when the defendant
suddenly appeared and assaulted him.
The affidavit stated that the victim and the defendant were friends. The
affidavit also stated that the victim and defendant along with another
person were involved in a theft and they were all arrested in that case.
