The Palau Social Security
Administration is seeking a court order to allow it to collect an amount
of over $100,000 in unpaid social security contributions from the Estate
of the late Senator Johnny Reklai.
In Civil Action No. 07-122, the SSA has filed a motion of proof of claim
that the court enter a judgment granting them the amount of $109,708.25.
The motion said the amount represent social security liabilities for JRCon,
SLC and Airai Garment.
The amount being collected by SSA included interest and penalties incurred
as a result of non-payment.
SSA in its civil action cited that " contributions, including penalties,
interests accrued and attorney fees thereon, imposed , authorized under
this chapter shall be a lien upon any property of the employer, having
priority over all other claims and liens including liens for other taxes
and may be collected by levy upon such property in the same manner as
the levy of excution."
The civil action said that SSA is entitled to an automatic lien against
Reklais Estate.
Earlier the Pacific Savings Bank receiver asked the court to appoint him
as administrator of Reklais Estate.
