Guanlao drops appeal to 9th circuit

AMALIA Abo Guanlao has voluntarily withdrawn her appeal to the U.S. Court of Appeals for the Ninth Circuit. It is not known why she dropped her appeal.

A long-time guest worker and mother of two U.S. citizen minors, she had been seeking a reversal of a 2013 immigration court order for her removal from the CNMI

On Aug. 13, District Court for the NMI designated Judge Frances M. Tydingco-Gatewood granted the U.S. Department of Justice’s motion to dismiss Guanlao’s lawsuit stating that she failed to exhaust administrative remedies for her claims.

In September, the Ninth Circuit denied Guanlao’s motion to reconsider its Aug. 23 denial of her emergency request to stay or suspend a federal court’s recent order against her.

Guanlao has been on Saipan since April 1994. As the wife of a CW-1 permit holder, she applied for CW-2 status, but it was denied. Two companies that wanted to hire Guanlao submitted CW-1 petitions for her, but they were also denied.
