Judge: Hillbroom can depose former lawyer on Guam

CHIEF Judge Ramona V. Manglona of the District Court for the NMI has granted the request of Junior Larry Hillbroom to depose attorney Barry J. Israel.

 Judge Manglona said Israel will be deposed on Guam and that Hillbroom “will front the reasonable costs” of Israel’s travels. Israel is in Vietnam.

Israel and attorney David Lujan represented Hillbroom when he was a minor. Hillbroom, now 34, secured $90 million from the Larry Lee Hillblom estate. A co-founder of DHL, Hillblom died in a plane crash in 1995 near Saipan. He was 52. He left behind an estate estimated to be about $600 million.

When he became an adult, Hillbroom sued Israel, Lujan and one-to-10 “does” for legal malpractice, breach of fiduciary duty, fraud, civil conspiracy and violation of the California Business and Professions Code.

Hillbroom also sued Keith Waibel, a trustee of Hillbroom’s trust, for conspiracy.

 At a hearing in federal court on Tuesday, attorneys Rachel A. Dimitruk and Nelson Werner appeared on behalf of Hillbroom via telephone while attorney Mark Hanson appeared in court.

 Israel was represented by attorneys Victorino Torres and Theodore Frank. The three  appeared via telephone. David Lujan and Keith Waibel also appeared pro se via telephone.

Dimitruk said Hillbroom is currently in jail in Palau  and “they are now looking at off-island facilities for his treatment.”

In June, in Palau, Hillbroom admitted to drug trafficking and was sentenced to 10 years probation and fined $50,000 as part of a plea bargain. The court also allowed him to leave Palau to undergo addiction therapy.
