AG: No settlement talks between CNMI, Luta Mermaid

THERE has been no settlement discussion in the CNMI government’s lawsuit against Luta Mermaid LLC in connection with the $400,000 in public funds “loaned” to the former  owner of the shipping vessel MV Luta, Attorney General Edward Manibusan said.

Nothing has changed in the positions of the parties, he added.   

In Feb. 2017, the Office of the Attorney General filed a complaint against Luta Mermaid LLC  for receiving public funds without authorization, wrongful retention of public funds, unjust enrichment, and using public funds for personal use.

Also named defendants were  officials: Abelina T. Mendiola, Deron T. Mendiola, Fidel S, Mendiola, and Fidel Mendiola Jr.

The AG’s office, which filed the case in the Superior Court  on behalf of the Department of Finance, is seeking the recovery of the public funds.

In Oct. 2018, Superior Court Presiding Judge Robert Naraja scheduled a final pretrial conference for Feb. 8, 2019 at 1:30 p.m. He said a final pretrial order will be issued on Feb. 13, 2019.

Before Typhoon Yutu hit Saipan, the judge set the bench trial for Oct. 29, 2018 at 9 a.m.
