Rezoning of property close to ARC approved

A DEVELOPER plans to build a condominium in the Achugao area on Chalan Pale Arnold next to Aqua Resort Club.

Architect Chris Fryling, at a Zoning Board meeting, said the project is appropriate for a village commercial area.

The developer, Sergey Tkachev, is asking the board to change the zoning designation of the property from village commercial and rural to village commercial only.

Zoning Administrator Therese Ogumoro said Tkachev’s property has a split boundary between village commercial and rural zones, and is adjacent to village commercial and public resource properties along Chalan Pale Arnold.

The split boundary between two zoning districts was a result of the enactment of the Saipan Zoning Law of 2013, Ogumor said, adding that it required properties within 300 feet on both sides of the centerline of the road to be rezoned to village commercial.

Tkachev’s property, she said, extends beyond 300 feet from the centerline of the road, and he is now requesting that his entire property be designated as village commercial to allow him to develop a condominium.

“This is allowable within village commercial zones,” she said.

Upon her recommendation, the board headed by Diego Blanco approved the applicant’s request.

For purposes of development, however, Blanco expressed concern about the future expansion of the establishments in the area in the two zoning districts.

“Why not rezone the rest of the area?” he asked.
