Former Guam cop found guilty of negligent homicide

HAGÅTÑA (The Guam Daily Post) — A jury has found former Guam Police Department officer Mark Torre Jr. guilty of negligent homicide and aggravated assault as a third-degree felony in the shooting death of then-fellow officer Elbert Piolo.

The jury reached its verdict at past 2 Thursday afternoon.

During the trial, the prosecution played the last words from Piolo, recorded on his 911 calls, pleading for help as he was bleeding from a gunshot wound. Piolo also was heard in his 911 calls saying “I’m dying. I’m dying. He shot me, he shot me.”

The defense argued that Piolo was suicidal, and shot himself while Torre was trying to stop Piolo from firing the defendant’s gun. The shooting occurred outside the Torre resident in July 2015.

Torre was charged with murder, manslaughter, negligent homicide, aggravated assault as a second-degree felony, and aggravated assault as a third-degree felony. Each charge came with a special allegation of use of a deadly weapon in the commission of a felony.

He was found not guilty of murder, manslaughter and aggravated assault as a second-degree felony.
