Pohl asks US court to dismiss ExxonMobil from discrimination lawsuit

THE man who filed a discrimination lawsuit against ExxonMobil for not hiring him for the position of field engineering technician wants the oil company dismissed from the case.

Nicolas Guy Pohl, through his attorney Matthew J. Holley, filed a notice of dismissing ExxonMobil from the lawsuit in the District Court for the NMI on Tuesday.

Holley said ExxonMobil has not filed a responsive pleading on the matter, and therefore Pohl is entitled to file the dismissal as a matter of right.

Pohl also sued Mobil Oil Marianas Inc. and its five unnamed officials. He alleged that they were in some manner responsible for the acts of discrimination against him.

Pohl is seeking damages for the violation of his civil rights and demands a jury trial.

According to his lawsuit, Mobil engaged in unlawful employment practices in violation of the Civil Rights Act of 1984 in August 2010 when Mobil favored employees who were not Caucasian or American.

Pohl said Mobil hired a non-Caucasian non-American for the job that he applied for.

He also accuses Mobil of favoring employees who are younger than 40 years old. He was 57 when he applied for the position at Mobil.
