Woman files notice of dismissal of lawsuit against DPL

A WOMAN who sued the Department of Public Lands and then-DPL Secretary Pedro A. Tenorio over a grazing permit in 2015 has filed a notice of dismissal of her lawsuit in federal court.

Congxiang Palacios sued DPL for breach of contract, saying it canceled her temporary agricultural and grazing permit because the “big boss” needed his land back.

She sued the then-DPL secretary for violation of due process and equal protection, and demanded payment for damages.

Palacios, through her counsel Braddock J. Huesman, filed the notice of dismissal on Tuesday.

Huesman said the defendants have not been served and have not filed an answer or a motion for summary judgment.

He said the lawsuit was not a class action and that a receiver has not been appointed.

The case, he added, is not governed by any federal statute that requires an order of the court for dismissal of the case.

But Huesman noted that the court issued an order that required Palacios to show cause or have the case dismissed.

He said Palacios is now working with DPL on a land lease. The dismissal notice is without prejudice, he added.
