Dotts says USDOL and IPI near resolving issue of wages owed to workers

IMPERIAL Pacific International LLC served a second subpoena on the Bank of Guam on June 8, 2021 to obtain cashed checks for the payroll period ended Jan. 15, 2021, attorney Michael Dotts said in IPI’s 22nd status report to the federal court.

“Once those checks are produced, IPI and the United States Department of Labor should be able to resolve the issue over how much is still owed to IPI employees,” Dotts added.

He also reported his planned travel.

“Undersigned counsel will be traveling starting on June 21 and, depending on quarantine requirements when he returns in July, he may be out of his office until July 20. During this time, counsel will continue to file weekly reports but, as he will be off island when finalizing them, it is possible that some extensions may be requested,” Dotts said.

According to the IPI lawyer, all remaining Taiwanese workers have been booked and scheduled to leave this Saturday, June 19, 2021, and next Monday, June 21, 2021.

“Filipino workers who have expressed interest in leaving have all been booked for July-August departures. Chinese workers are still waiting for the China Embassy to approve flights back to China from Saipan. Tentative dates for travel back to China are mid to late July,” Dotts said.

As for IPI’s settlement payments, Dotts said the next one is due on July 1.

Regarding payroll, it was “timely distributed on Friday, June 4, without issue. IPI’s next payroll is to be distributed on June 18, (Payroll 13),” he added.

“There is no change to report with regard to housing and food.”

Construction work at the Imperial Pacific Resort in Garapan remains suspended as ordered by the court, Dotts said.

Chief Judge Ramona V. Manglona previously ordered IPI and former IPI chairwoman Cui Li Jie to purge their contempt by March 12, 2021 by paying $1,182,793 owed as back wages under the 2019 consent judgment or go into receivership.     

On March 23, 2021, IPI and USDOL requested the court to modify the 2019 consent judgment through a stipulation.

The total amount owed under the previous consent judgment was $3,360,000. According to the stipulation of the parties, IPI paid a total of $1,929,425.28 toward the consent judgment from March 2019 to March 2021. The remaining balance from the previous consent judgment was $1,430,574 plus $47,856 in wages currently owed for a total amount of $1,478,430 due in the first amended consent judgment.  

IPI was ordered to make incremental monthly payments of $164,270.08 from April 1, 2021 to Dec. 1, 2021 for a total amount of $1,478,430.72.

From April to date, IPI has made payments totaling $492,810.24.
