FRITZ Pacific Project Development Services, through its principal, Alfredo Cabael, has filed a complaint against Imperial Pacific International LLC for breach of manpower staffing subcontract last year.

Fritz Pacific is seeking an award for nonpayment of manpower staffing services, interest, fees and costs in the amount of $745,303.90.
In response to the complaint, IPI, represented by attorney Stephen Nutting, said IPI is “without sufficient information to affirm or deny the allegations….”
But IPI admits that “there remains outstanding a sum due to the plaintiff that remains unpaid.”
However, IPI denies that the amount demanded by the plaintiff is “a correct and accurate accounting of work performed and amount due.”
IPI claims that the plaintiffs “failed to correctly bill for work completed, and/or failed to provide credit for payments made” by the defendant.
IPI likewise said that the plaintiffs are asserting claims for work not completed or overstating hours worked and charges incurred.
According to Nutting, IPI “reserves the right to assert any available affirmative defense that may be discovered during the course of discovery in this proceeding.”
The complaint stated that IPI hired Fritz Pacific to provide manpower staffing services for the hotel-casino construction project in Garapan.
IPI and Fritz Pacific entered into two successive contracts beginning around June or August 2018.
As part of the agreement, Fritz Pacific was to provide IPI with skilled plumbers, carpenters, masons, electricians, welders, skilled helpers, tower crane operators, heavy equipment mechanics, mechanic helpers, equipment electronics technicians, tractor trailer operators, boom truck operators, riggers, and two laborers.
The complaint stated that staffing hours, statements of account, billing, invoices, and payroll records from Fritz Pacific were confirmed with IPI-executed timesheets.
But according to the complaint, IPI only made partial payments toward the billings and invoices.
In November 2019, AM Group took over as IPI’s manpower staffing company, effectively terminating Fritz Pacific’s staffing services, the complaint added.
