Another lawyer, trustee sued in federal court over Hillblom estate

Junior Larry Hillbroom through his lawyer Mark Hanson named Barry J. Israel, Keith A. Waibel, and 10 Does in the 29-page complaint filed in the U.S. District Court for the NMI.

Israel, Waibel and the 10 Does were sued for legal malpractice, negligence, breach of fiduciary duty, fraud, and violation of the Racketeer Influenced and Corrupt Organizations Act.

Hanson is demanding a jury trial.

A lawyer, Israel was retained to represent his client and his interest in a settlement case, while Waibel was one of the two trustees of Hillblom’s estate, the complaint said.

Hanson said Junior discovered the illegal acts after meeting an agent of the Federal Bureau of Investigation in San Francisco, California on Nov. 10, 2006.

Hanson said “Junior discovered for the first time that his ultimate recovery after the attorneys deducted their inappropriate fees and unsubstantiated costs from his approximately $90 million settlement of the Hillblom Probate Case was only about $12 million.”

“Defendants’ misconduct was malicious, fraudulent, oppressive, and intended to injure [Junior]. Consequently, [Junior] is entitled to punitive and/or a damages multiplier as provided by statute,” Hanson said.

Israel and Waibel were named in the earlier lawsuit filed by Junior against David Lujan, a Guam-based attorney.

One of the founders of DHL, Hillblom died in a plane crash in May 1995 and left an estate amounting close to $550 million.

Hillbroom was still a minor at the time.
