Attorney F. Matthew Smith is representing Mariel Falalimpa on behalf of her spouse Joselito Baysauli Falalimpa, 44.
Smith said he and his client are still discussing what to do after Judge Ramona v. Manglona dismissed the two claims of negligence and emotional distress filed against the defendants, and not the lawsuit as earlier reported by the Variety.
“Our position is that the matter should proceed,” he added, referring to their third claim, wrongful death, filed by the widow “on her own behalf and as personal representative” of her husband.
Mrs. Falalimpa sued Duane Quitugua Richards, Marvin Tydingco, and Melva Ann Ada for the death of her husband who was killed by a vehicle driven by Richards and owned by the two other defendants.
